Terms and Conditions

In consideration of FindraCapital (hereinafter referred to as “FindraCapital”, which expression shall include where appropriate its affiliates, successors, and assigns), the User agrees to be bound by these Terms and Conditions as amended, supplemented, or superseded by FindraCapital from time to time.

These Terms and Conditions (“Terms”) apply to any loan or credit product facilitated through the Platform, including but not limited to personal loans, home loans, vehicle loans, business loans, and other loan products offered by Lending Partners from time to time.

These Terms establish an agreement between FindraCapital, having its principal place of business at Knowledge City Rd, Panmaktha, Madhapur, Rai Durg, Hyderabad, Telangana 500032, and You, and govern Your use of the FindraCapital website at findracapital.com and related online services (“Platform”) and the services set out in these Terms (“Services”).

Supplemental terms may apply to specific Services and will be disclosed to You in connection with the applicable Service. Supplemental terms are in addition to, and form part of, these Terms. In the event of conflict, supplemental terms prevail for the applicable Service.

FindraCapital may amend these Terms at its sole discretion. Unless otherwise stated, amendments are effective upon posting on the Platform. Your continued access or use of the Services after such posting constitutes Your consent to the amended Terms.

1. Eligibility / Condition Precedent

FindraCapital may facilitate loan applications only where the following conditions are met:

• You are at least eighteen (18) years of age.
• You are a citizen of India and a natural person (automated or bot access is not permitted).
• You are solvent and capable of entering into these Terms and performing Your obligations.
• Your application and supporting documents are complete, accurate, and accepted by FindraCapital and/or the relevant Lending Partner.
• All representations and warranties made by You remain true at the time of application and disbursement.
• Any other conditions precedent required by FindraCapital or a Lending Partner are fulfilled.

2. Account Set-Up

• Using the Platform may require You to submit information such as Your name, address, mobile number, email address, and other identifiers issued by FindraCapital or a Lending Partner.
• You agree to provide and maintain accurate, complete, and up-to-date information. Failure to do so may result in inability to access Services or termination of access.
• You are responsible for all activity under Your account and for maintaining the confidentiality of Your login credentials.
• Unless permitted in writing, You may maintain only one account with FindraCapital. Misuse of Your account for reasons not attributable to FindraCapital is Your responsibility.
• Data submitted for account set-up may be used by FindraCapital in accordance with our Privacy Policy, which forms part of these Terms.

3. Service

• FindraCapital acts as a Direct Selling Agent (DSA) and digital facilitation platform. The Services enable You to submit loan applications (“Credit Facility Application”) to RBI-regulated banks and NBFCs (“Lending Partners”) after preliminary collection and verification of information You provide. FindraCapital is under no obligation to disclose its internal assessment of creditworthiness.
• You acknowledge that submission of an application is based on information, formats, and processes determined by FindraCapital and Lending Partners.
• FindraCapital or a Lending Partner may verify information, check credit references, employment details, and obtain credit reports to determine creditworthiness, with Your consent where required.
• The Services do not guarantee that any loan or advance sought by You will be approved or disbursed. The final lending decision rests solely with the Lending Partner using its own policies and methodologies. A Lending Partner may reject any application referred by FindraCapital.
• Lending Partners may require additional documentation and execution of separate loan documentation before disbursement.
• Repayment: If a loan is sanctioned, You must repay the advance along with interest, charges, and fees as prescribed by the Lending Partner. FindraCapital’s role is limited to facilitating Your connection with credit providers; its facilitation role in respect of a particular application concludes once You are connected with a Lending Partner, subject to ongoing support communications as applicable.
• Separate transactions: Any loan disbursed is a distinct agreement between You and the Lending Partner. Disputes regarding disbursement, repayment, or loan terms must be resolved directly with the Lending Partner.
• Network access: You are responsible for obtaining internet access and compatible devices. FindraCapital does not guarantee uninterrupted or error-free operation of the Platform.

License

Subject to compliance with these Terms, FindraCapital grants You a limited, non-exclusive, revocable, non-transferable license in India to access and use the Platform solely for personal, non-commercial use in connection with the Services. All rights not expressly granted are reserved by FindraCapital.

Restrictions

You may not:

• Use the Services except as expressly permitted in these Terms.
• Provide third parties with unauthorised access to the Platform.
• Use the Services to transmit spam, malware, or unauthorised promotional material.
• Remove proprietary notices, reverse engineer, scrape, or attempt unauthorised access to the Platform.
• Upload or share unlawful, defamatory, infringing, misleading, or harmful content.
• Impersonate another person or misuse the Platform in violation of applicable law.

User Content

You are solely responsible for documents, messages, and other content You submit through the Platform. FindraCapital does not guarantee the accuracy of User-submitted content and is not liable for loss of data unless caused by its wilful misconduct or gross negligence. You should retain copies of important documents submitted through the Platform.

4. Limited Warranty

• You acknowledge risks inherent in transmitting information over the internet. FindraCapital employs commercially reasonable security measures but does not warrant that the Platform will be free from loss, corruption, attack, or unauthorised access.
• The Services are provided on an “as is” and “as available” basis without warranties of merchantability, fitness for a particular purpose, or uninterrupted operation, except as expressly stated herein.
• The Platform is not intended for use in environments where failure or delay could cause death, personal injury, or severe physical or environmental damage.

5. Confidential Information

Either party may share confidential information in the course of dealings. The receiving party agrees to protect such information with reasonable care and not disclose it without prior written consent, except as required by law or to perform the Services.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FINDRACAPITAL SHALL NOT BE LIABLE FOR ANY LOSS OF PROFITS, BUSINESS, CONTRACTS, REVENUES, GOODWILL, OR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE.

7. Indemnity

You shall defend, indemnify, and hold harmless FindraCapital, its officers, directors, employees, and agents from claims, damages, losses, and costs (including reasonable legal fees) arising from Your use of the Services, violation of these Terms, violation of third-party rights, or inaccurate information submitted by You. This obligation survives termination.

8. Privacy

By using the Services, You consent to collection and use of information as described in our Privacy Policy. Information may be processed and stored in India in accordance with applicable law.

9. Assignment

You may not assign this agreement without the prior written consent of FindraCapital.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts at Hyderabad, Telangana, India.

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force to the extent permitted by law.

13. Waiver

No waiver of any breach constitutes a waiver of any other breach. Waivers are effective only if made in writing by an authorised representative.

14. Force Majeure

FindraCapital is not liable for failure or delay caused by events beyond its reasonable control, including natural disasters, strikes, riots, fire, flood, or government action.

15. Other Financial Products

FindraCapital may, with Your consent, refer You to partner institutions for credit cards or other financial products. Partner institutions may contact You through calls, SMS, or email regarding such products. Lending and product decisions remain with the respective institution.

16. Entire Agreement

These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between the parties regarding the subject matter herein. Modifications are effective only when posted on this page or otherwise agreed in writing.

FindraCapital provides a digital platform to help Users discover and apply for loans from partner lenders across India. You are responsible for reviewing these Terms periodically. FindraCapital is not obliged to provide individual notice of every update.
